Welcome to Drey. Drey is owned and operated by Tuxedo Lab LLC. These Terms and Conditions ("Terms") govern your access to and use of the Drey mobile application, related app services, and related pages on the Tuxedo Lab website.
By downloading, accessing, using, tapping to accept, completing onboarding, or purchasing paid features in Drey, you agree to these Terms and to our Privacy Policy. These Terms supplement Apple's Standard Licensed Application End User License Agreement for App Store apps. If these Terms conflict with Apple's mandatory App Store terms, Apple's mandatory terms control only to the extent of the conflict. If you do not agree, do not use Drey.
Drey helps you save links you want to read, watch, or listen to later, organize those links into lists, and use reminders or local notifications to return to those lists. Drey may fetch titles, thumbnails, and other metadata from linked websites to make saved items easier to recognize.
Drey does not host, own, or control the third-party websites, videos, podcasts, music, articles, or other content that you save as links.
Drey is not directed to children under 13 and should not be used by children under 13. If you are under the age of majority where you live, you may use Drey only with permission from a parent or legal guardian. By using Drey, you represent that you are legally able to agree to these Terms and that your use of Drey complies with applicable laws.
You are responsible for the links, list names, reminder names, notes, edits, and other content you add to Drey. You represent that you have the right to save and use that content for your personal use and that your use of Drey will not violate the rights of any person or third party.
Drey currently stores saved app content locally on your device. Drey does not currently provide cloud sync, so Tuxedo Lab LLC generally cannot access, recover, export, or delete your locally stored saved links, lists, reminders, history, or preferences for you. You are responsible for backing up your device if you want to preserve local app content.
You retain any rights you have in your own content. You grant Tuxedo Lab LLC a limited license to process and display local app content in Drey only as needed to provide the app's features, and to process, store, transmit, and use app content only where you submit it to us, where it appears in support communications or diagnostic reports, or where otherwise needed to provide, secure, support, and improve Drey.
Drey may let you save links to third-party websites and services. Your use of those websites and services is governed by their own terms and privacy policies. Tuxedo Lab LLC is not responsible for third-party content, availability, accuracy, policies, or practices.
Drey may fetch oEmbed or other metadata from linked websites or provider endpoints from your device. You agree not to use Drey to scrape, copy, download, redistribute, or access third-party content in a way that violates a third party's rights or terms. Drey is intended to save references to content, not to download or redistribute third-party media files.
Tuxedo Lab LLC has no obligation to monitor, review, verify, preserve, restore, remove, or police the links, titles, metadata, websites, services, or other third-party content you choose to save or access through Drey.
Drey may provide local notifications for reminders you create in the app. Notifications are optional and may be controlled through iOS settings and, where available, in-app settings.
Local notifications may include list names. You should avoid using sensitive information in list names or reminder names if you do not want that information to appear in notifications.
Drey may offer free features and paid Pro features. Pro features may unlock additional or expanded app functionality. The specific features, limits, prices, and billing terms will be presented in the app or App Store purchase flow before purchase.
Paid digital features for the iOS app must be purchased through the Apple App Store purchase flow. Drey uses RevenueCat to manage purchase status and feature entitlements. Drey will not require you to allow optional analytics, tracking-related measurement, or diagnostic sharing in order to access paid features.
App Store purchases, subscriptions, renewals, cancellations, billing, and refunds are handled by Apple and are subject to Apple's terms and policies. Tuxedo Lab LLC does not receive your full payment card details and does not control Apple's refund decisions.
If Drey offers an auto-renewing subscription, the subscription will renew automatically unless you cancel it before the end of the then-current subscription period. The subscription period, price, trial terms if any, and what is included during each period will be shown in the app or App Store purchase flow before purchase. Payment will be charged to your Apple ID through the App Store. You can manage or cancel subscriptions through your Apple ID or App Store settings.
If a purchase cannot be validated, expires, is canceled, or is refunded, Drey may remove access to the related Pro features. Existing local content is not intentionally deleted merely because your paid feature access ends, but free-tier creation limits may apply.
You agree not to use Drey to:
Drey does not control the content of links you choose to save. You are solely responsible for the content you save, the third-party services you access, and your compliance with applicable laws and third-party terms. You agree that Tuxedo Lab LLC may disable or restrict features, services, or entitlement validation if needed to protect Drey, users, service providers, third parties, or Tuxedo Lab LLC.
Drey, including its software, design, branding, text, graphics, features, and other materials, is owned by Tuxedo Lab LLC or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Drey to you.
Subject to these Terms, Tuxedo Lab LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Drey for your personal, non-commercial use.
If you send us ideas, suggestions, or feedback, you grant Tuxedo Lab LLC the right to use them without restriction or compensation to you.
Our collection and use of information is described in the Drey Privacy Policy. By using Drey, you agree that we may process information as described there.
We may modify, suspend, or discontinue Drey or any feature at any time. We may also add, remove, or change free or Pro features, subject to applicable law and any commitments made in the applicable purchase flow.
Tuxedo Lab LLC is responsible for support and maintenance of Drey as described in these Terms and applicable law. Apple is not responsible for providing maintenance or support services for Drey.
If you downloaded Drey from the Apple App Store, you acknowledge that these Terms are between you and Tuxedo Lab LLC, not Apple. Drey is licensed, not sold, and your use of Drey is also subject to Apple's Standard Licensed Application End User License Agreement unless a different license agreement is provided through App Store Connect. Apple is not responsible for Drey, its content, support, warranties, claims, or third-party intellectual property claims, except as required by applicable law.
Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of Drey from the Apple App Store, and Apple has the right to enforce those provisions against you.
Drey is provided "as is" and "as available." To the maximum extent permitted by law, Tuxedo Lab LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that Drey will be uninterrupted, error-free, secure, or available at all times, or that link metadata, thumbnails, reminders, notifications, paid features, entitlement validation, analytics, or third-party content will always be accurate, complete, recoverable, or available.
To the maximum extent permitted by law, Tuxedo Lab LLC is not responsible for lost, deleted, damaged, unavailable, or unrecoverable local app content; failed, missing, or outdated device backups; unavailable third-party websites or metadata providers; inaccurate metadata; removed third-party content; or your failure to preserve local app content.
To the maximum extent permitted by law, Tuxedo Lab LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of Drey.
To the maximum extent permitted by law, Tuxedo Lab LLC's total liability for any claim arising out of or related to Drey or these Terms will not exceed the greater of the amount you paid to use Drey in the twelve months before the claim or fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Tuxedo Lab LLC and its owners, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of Drey; your saved links, list names, reminder names, notes, edits, or other app content; your violation of these Terms; your violation of any law, regulation, third-party right, or third-party service term; your use of third-party websites or services; your scraping, downloading, redistribution, or unauthorized use of third-party media or metadata; or any claim that content you save, submit, or cause Drey to process infringes, violates, or harms any person or third party.
You may stop using Drey at any time. We may terminate the license granted under these Terms, stop providing related services, support, updates, or entitlement validation, or restrict access to Pro features if we believe you violated these Terms, if required by law, or if necessary to protect Drey, users, or Tuxedo Lab LLC.
Sections that by their nature should survive termination will survive, including sections relating to intellectual property, privacy, disclaimers, limitation of liability, indemnification, and dispute terms.
You may not use, export, re-export, import, or transfer Drey except as authorized by United States law and the laws of the jurisdiction where Drey was obtained. You represent that you are not located in a country or on a list where use of Drey would be prohibited under applicable export-control or sanctions laws, and that you will not use Drey for purposes prohibited by United States law.
We may update these Terms from time to time. When we make changes, we will update the effective date above. Your continued use of Drey after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules, except where applicable consumer protection laws require otherwise.
Before filing a claim, you and Tuxedo Lab LLC agree to try to resolve the dispute informally by sending a written description of the dispute, the relief requested, and contact information to the other party and allowing at least thirty (30) days for a response.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to Drey or these Terms that cannot be resolved informally will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if the claim qualifies. Arbitration will be conducted on an individual basis and not as a class, collective, consolidated, representative, or private-attorney-general action.
To the maximum extent permitted by law, you and Tuxedo Lab LLC waive the right to a jury trial and waive the right to participate in a class action, collective action, consolidated action, representative action, or private-attorney-general action related to Drey or these Terms. If arbitration is unavailable or unenforceable for a particular claim, that claim must be brought only in the state or federal courts located in Massachusetts, unless applicable law requires a different forum.
To the maximum extent permitted by law, any claim arising out of or related to Drey or these Terms must be filed within one (1) year after the claim arises, or it will be permanently barred.
